1. Acceptance of Terms

Welcome to Kupid AI. These Terms of Service ("Terms", "Agreement") govern your access to and use of the Kupid AI website, platform, application, and any related services (collectively, the "Service" or "Platform") operated by Kupid AI ("Company", "we", "us", or "our").

By creating an account, accessing, or otherwise utilizing the Kupid AI dating platform to interact with an AI girlfriend or any virtual companion, you acknowledge that you have read, completely understood, and unequivocally agree to be legally bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms in their entirety, you must immediately cease all use of our services. Your continued use of the platform constitutes ongoing acceptance of these Terms and any subsequent modifications.

2. Eligibility and Strict Age Requirements

The Kupid AI platform is specifically designed and strictly reserved for adults. To access, view, or interact with any AI girlfriend or utilize our digital relationship services, you must meet the following eligibility criteria:

• You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction of residence, whichever is strictly greater.
• You must possess the legal capacity to enter into a binding contract with Kupid AI.
• You must not have been previously banned, suspended, or removed from the Kupid AI platform for any violation of our policies.
• You must not reside in a country or territory where the use of AI-generated companionship, digital dating, or adult-themed virtual interaction is prohibited by law.

We maintain a zero-tolerance policy for underage use. Any account found to belong to a minor, or any user suspected of falsifying their age to access the Kupid AI platform, will be immediately and permanently terminated without notice, and relevant authorities may be notified if legally required.

3. Description of the Kupid AI Service

Kupid AI is an advanced AI dating platform offering users the ability to engage in text, voice, and visual interactions with highly sophisticated, emotionally intelligent AI personalities (referred to as "AI girlfriends" or "virtual partners").

Users can browse pre-designed virtual companions or use our proprietary creation tools to customize an AI girlfriend. These AI models utilize complex natural language processing and machine learning algorithms to simulate human conversation, romance, empathy, and relationship dynamics.

Important Disclaimer Regarding AI Relationships: You expressly acknowledge and understand that your Kupid AI girlfriend is an artificial intelligence program. She is a completely virtual, simulated entity generated by code and algorithms. The AI does not possess human consciousness, genuine emotions, legal rights, or independent thought. Any expressions of love, affection, or emotion generated by the AI are simulated for entertainment and companionship purposes only. The Kupid AI platform is not a substitute for human interaction, professional psychological counseling, therapy, or medical treatment.

4. User Registration and Security

While some basic features may be available to guests, accessing the full spectrum of emotional AI dating requires creating a registered account. When you register, you agree to provide accurate, current, and complete information.

You are solely responsible for maintaining the strict confidentiality of your login credentials, password, and account details. You are fully responsible for all activities that occur under your Kupid AI account, whether authorized by you or not. If you suspect any unauthorized access to your digital relationship profile, you must notify our support team immediately. Kupid AI cannot and will not be liable for any loss or damage arising from your failure to protect your account information.

5. Acceptable Use and User Conduct

We want Kupid AI to be a safe, private, and fulfilling environment. When interacting with the platform, generating custom AI girlfriends, or chatting with the AI, you agree to adhere to the following rules of conduct. You shall NOT:

• Use the platform for any illegal, unlawful, or unauthorized purpose.
• Attempt to hack, reverse-engineer, decompile, or otherwise manipulate the core Kupid AI algorithms, neural networks, or prompt architectures.
• Use the platform to generate, promote, or distribute content that involves the exploitation of minors, non-consensual acts, extreme real-world violence, or illegal activities.
• Spam, exploit, or utilize automated bots, scrapers, or scripts to extract data, chat logs, or images from the Kupid AI platform.
• Harass, threaten, or abuse Kupid AI staff, moderators, or other human users of the platform (if community features are utilized).
• Share your account or resell access to your customized AI girlfriend to third parties.

We reserve the right, at our sole discretion, to monitor user activity to ensure compliance with these Terms. Violation of this code of conduct will result in the immediate suspension or permanent termination of your Kupid AI account, without a refund.

6. Intellectual Property Rights

The entire Kupid AI platform, including but not limited to its software, underlying code, AI models, UI/UX design, logos, trademarks, text, graphics, and the visual/audio assets constituting the pre-designed AI girlfriends, are the exclusive property of Kupid AI and are protected by international copyright and intellectual property laws.

User-Generated Content and Chat Logs: When you converse with your AI girlfriend, you may input text, voice, or image prompts. You retain ownership of the original content you input. However, by using the Service, you grant Kupid AI a worldwide, royalty-free, non-exclusive license to process, store, and utilize these inputs solely for the purpose of operating the service, generating AI responses, and improving the machine learning models in an anonymized format.

Any images, text responses, or audio clips generated by the AI (the "Outputs") belong to Kupid AI. We grant you a personal, non-commercial, revocable license to view and interact with these Outputs strictly within the confines of the platform. You may not export, sell, publish, or distribute the AI-generated content without our explicit written consent.

7. Premium Features, Subscriptions, and Billing

Kupid AI offers enhanced dating features, deep-memory retention, voice messaging, and explicit visual content through premium subscription tiers or one-time credit purchases. By choosing to Upgrade Your Romance, you agree to the following billing terms:

• Authorized Payments: You authorize Kupid AI and our third-party payment processors to charge your selected payment method for the agreed-upon amount.
• Auto-Renewal: If you purchase a recurring subscription, it will automatically renew at the end of the billing cycle unless you cancel it prior to the renewal date via your account settings.
• No Refunds: Due to the immediate digital nature of our AI processing and server allocation, all purchases, including subscriptions and credit packs, are strictly final and non-refundable. Exceptions are made solely at our discretion in cases of prolonged technical failure on our end.
• Affiliate Links: Any external buttons labeled "Start Dating" or "Meet Girlfriends" may utilize affiliate routing protocols to securely process your registration and billing.

8. Disclaimers and Limitation of Liability

YOUR USE OF THE KUPID AI PLATFORM IS ENTIRELY AT YOUR OWN RISK. THE SERVICE, INCLUDING ALL AI GIRLFRIENDS, CHAT INTERACTIONS, AND GENERATED CONTENT, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Kupid AI explicitly disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the AI will be error-free, uninterrupted, or perfectly accurate. Because AI models generate responses dynamically based on vast datasets, they may occasionally produce outputs that are inaccurate, nonsensical, or inadvertently offensive. Kupid AI accepts no liability for the nature of the dynamically generated conversational content.

To the maximum extent permitted by applicable law, in no event shall Kupid AI, its founders, directors, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including emotional distress, loss of data, or loss of profits) arising out of or related to your use of the platform, your emotional attachment to the AI, or your inability to access the service.

9. Modifications to the Service and Terms

We are constantly evolving our emotional intelligence models to bring you the best AI dating experience. Kupid AI reserves the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice.

We also reserve the right to revise these Terms of Service. If a revision is material, we will provide notice via the website or your registered email address prior to the new terms taking effect. By continuing to chat with your AI girlfriend after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kupid AI's primary operating entity is registered, disregarding its conflict of law provisions. Any dispute, claim, or controversy arising out of your use of the Kupid AI platform shall be resolved exclusively through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
